Terms and Conditions of Lolipopshop e-shop

§ 1 General information

  1. The Terms and Conditions specify the rules of using the e-shop at http://lolipopshop.pl , operated by Monika Skwarczyńska Lolipop with its registered office in Kraków, ul. Odrowąża 38/3, 30-009 Kraków, NIP 6792697651.
  2. Customers may contact the Shop by e-mail: info@lolipopshop.pl and additionally by telephone: +48 531982399.

§ 2 Product prices and payment

  1. All product prices are shown in PLN and they are gross prices inclusive of VAT.
  2. Customers may pay for the ordered goods using one of the following payment methods:
    • payment by a bank transfer on bank account owners of shop Lolipopshop : Idea bank Monika Skwarczyńska Lolipop 22 1950 0001 2006 0313 8386 0002.
    • immediate payment by a transfer or credit card via PayPal.

§ 3 Delivery

  1. The orders are posted within 2 working days as of the payment date
  2. The time limit for the completion of the performance includes the time needed for posting  and delivery.
  3. Delivery time in Poland – up to 2 working days as of posting (courier service).
  4. Costs of delivery on the territory of Poland PLN 15.
  5. Delivery time for shipment abroad in the EU – up to 14 working days, outside the EU – up to 60 working days.
  6. The cost of shipment abroad is determined individually depending on the country, and it is displayed during the order placement process after the relevant country has been chosen.
  7. The items delivered to Consumers by the Seller shall be free of any defects.
  8. As regards Customers who are not consumers, the Seller is not liable for any delayed deliveries.

§ 4 Right of withdrawal

Consumers have the right to withdraw from the agreement on the terms specified in the Instruction attached to the Terms and Conditions.

§ 5 Complaints

  1. Complaints may be reported to the e-mail address info@lolipopshop.pl or sent to the Seller's address: Monika Skwarczyńska Lolipop ul.Pedzichow 19/3 31-152 Krakow Poland.
  2. A complaint should include: Customer contact data, information allowing the identification of the order subject to the complaint, as well as the content of the complaint.
  3. If a complaint is filed by a Customer who is a consumer, the Seller shall process it within 14 days.
  4. If a complaint is filed by a Customer who is not a consumer, the time limit specified hereinabove may be extended.
  5. The person filing the complaint may also seek the enforcement of their rights on general terms by pursuing their claims in court, and, if both parties agree, by using the out-of-court methods of processing complaints and pursuing claims.

§ 6 Personal data

  1. The administrator of personal data is Monika Skwarczyńska Lolipop with its registered office in Krakow ul.Odrowąża 38/3 30-009.
  2. The provision of data is voluntary; however, it is necessary for the fulfilment of the order.
  3. The submitted data will be processed by the Seller for the purpose of fulfilling the order and, additionally, for the tax and accounting purposes, evidential purposes, and for the purpose of maintaining internal statistics.
  4. The data shall not be transferred to other entities unless such a transfer is necessary to fulfil the order.
  5. If a customer gives a separate consent for receiving the newsletter or signs up for the newsletter with their e-mail, which will be provided only for this purpose, the data of such persons will be used to send them the ordered newsletter.
  6. Customers may access and modify their personal data.

§ 7 Final provisions

  1. The Terms and Conditions enter into force on 01 January 2018 and shall be applicable to agreements concluded as of this date.
  2. As regards Customers who are not consumers, the court of competent jurisdiction to settle any and all disputes shall be the court of competent jurisdiction over the registered office of the Seller.

You have the right to withdraw from the agreement within 14 days without a cause.
The time limit for withdrawing from the agreement expires 14 days as of the day when you took the item in possession or when a third party appointed by you, other than the carrier, took the item in possession.

The notification should be submitted in the form of an express statement (for example a letter sent by post or e-mail).

You may, but do not have to, use the model withdrawal form. You may also fill in and send the withdrawal form or any other express statement by electronic means, using our website: www.lolipopshop.plIf you take this opportunity, we will immediately send you the confirmation of receipt of the information concerning your withdrawal from the agreement on a durable medium (e.g. by e-mail).

In order to observe the time limit for withdrawing from the agreement, you just need to send the notification of the exercise of your right to withdraw from the agreement before the time limit for withdrawing from the agreement has expired.
The effects of withdrawal from the agreement: In the event that you withdraw from this agreement, we will return all the payments we have received from you, including the costs of delivery of the item (except the additional costs resulting from the delivery method you selected, other than the cheapest ordinary delivery method offered by us), without undue delay but, at all times, not later than within 14 days as of the day when we were notified of your decision to exercise the right to withdraw from this agreement. The payment will be returned by means of the same payment method that you used in the original transaction, unless you issue an express consent to a different solution; at all times, you will not incur any costs in relation to such a return.

without undue delay but, at all times, not later than within 14 days as of the day when you informed us about your withdrawal from the agreement. The time limit is deemed to have been observed if you send the item before the expiration of the 14-day period.

You will be obliged to incur the direct costs of returning the item.

You are liable only for the decrease in the item value that results from using the item beyond the scope necessary to determine the nature, features and functioning of the item.

Explanations: “In order to establish the nature, characteristics and functioning of the goods, the consumer should only handle and inspect them in the same manner as he would be allowed to do in a shop. For example, the consumer should only try on a garment and should not be allowed to wear it”.
